By accessing or using the Pickens Rewards platform ("Pickens," "we," "us," or "our"), including our website at pickensrewards.com and any associated services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not create an account or use the Platform.

We reserve the right to verify your eligibility at any time and to suspend or terminate accounts that do not meet these criteria.

We reserve the right to adjust, revoke, or void earnings that were credited in error, obtained through fraudulent activity, or associated with returned or cancelled purchases. If your account balance is affected, we will make reasonable efforts to notify you.
Pickens allows you to submit product reviews, feedback, and other content ("User Content"). By submitting User Content, you agree that:

Violation of these rules may result in suspension or permanent termination of your account and forfeiture of any pending or confirmed earnings.
The Platform contains links to third-party websites, retailers, and services, including affiliate partner stores, TapResearch, Besitos, and Tango. These third-party services have their own terms of service and privacy policies. Pickens is not responsible for the content, practices, products, or services of any third party. Your interactions with third-party services, including purchases made through affiliate links, are solely between you and that third party. We are not a party to those transactions and are not liable for any disputes arising from them.
The Platform, including its design, branding, logos, text, graphics, curated content, software, and all other materials ("Pickens Content"), is owned by Pickens Rewards and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on Pickens Content without our prior written consent. The Pickens name, logo, and tagline "Earn beautifully. Shop wisely." are trademarks of Pickens Rewards.
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Pickens disclaims all warranties, express or implied, including but not limited to:
Pickens is a product discovery and cashback platform. We curate and feature products and brands, but we do not manufacture, sell, or fulfill any products. Any purchases you make are directly with the third-party retailer, and all product-related issues (returns, refunds, defects, shipping) should be resolved with that retailer.
To the maximum extent permitted by law, Pickens Rewards, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, earnings, data, or goodwill, arising out of or related to your use of the Platform, any third-party products or services, untracked or uncredited cashback, or any other matter relating to these Terms. Our total liability for any claim arising from or related to these Terms or your use of the Platform shall not exceed the total amount of confirmed earnings in your account at the time of the claim, or fifty dollars ($50), whichever is greater.
You agree to indemnify, defend, and hold harmless Pickens Rewards and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your User Content, your violation of these Terms, or your violation of any rights of another.
We may suspend or terminate your account and access to the Platform at our discretion, with or without notice, for reasons including but not limited to:
Upon termination, your right to use the Platform ceases immediately. Any pending or unconfirmed earnings will be forfeited. Confirmed earnings may be redeemed within 30 days of termination, subject to minimum cashout thresholds. If your account is terminated for fraud or abuse, all earnings (pending and confirmed) will be forfeited.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you via email or a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you may close your account before they take effect.
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Platform shall be resolved in the state or federal courts located in Mecklenburg County, North Carolina. You agree to submit to the personal jurisdiction of those courts.
